Terms of Use — Hot Take

1. Acceptance of Terms
These Terms of Use ("Terms") govern your access to and use of Hot Take (the "App"), developed by Peerware Ltd, a company registered in England and Wales ("we", "us", "our"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
These Terms work alongside our Privacy Policy, which explains what data we collect and how we use it. If you access the App through the Apple App Store, your purchase and license are also governed by Apple's Standard End User License Agreement — these Terms cover how you use the App itself and do not replace that agreement.
2. Description of the App
Hot Take is a social party game in which players vote privately on opinion statements, then compare their group's votes against each other and against aggregate votes from other players worldwide. The App supports both single-device (pass-and-play) and multiplayer modes.
We may update, change, or discontinue features of the App at any time, with or without notice.
3. Eligibility
The base app (General, Relationships, Work, and Food categories) is intended for a general audience. You must be at least 13 years old to use the App. If you are under 18, you may only use the App with the involvement of a parent or guardian.
Age-restricted content: The Spicy Pack 🌶️, Dark Pack 🖤, and Couples & Dating Pack 💋 contain mature themes and are intended only for users aged 17 and older. By purchasing or unlocking any of these packs, you confirm that you are at least 17 years old.
4. Accounts
Hot Take does not require you to create an account or provide a real name, email address, or phone number. Player names you enter are used only to identify you within a single game or session, as described in our Privacy Policy.
5. In-App Purchases
The App offers the following as one-time, non-consumable purchases: Spicy Pack, Dark Pack, Couples & Dating Pack, Remove Ads, and Hot Take Pro. None of these are subscriptions — each is a single purchase that unlocks content permanently on your account with the relevant app store.
All purchases are processed by the Apple App Store or Google Play, not directly by us. Their payment terms, refund policies, and billing terms apply.
We use RevenueCat to verify purchases and manage entitlements across sessions. See our Privacy Policy for details.
Prices are shown in your local currency at the time of purchase and may vary by region.
Refunds are handled by Apple or Google according to their own policies — we do not process refunds directly and cannot guarantee any specific outcome.
Use the "Restore Purchases" option in the App to recover entitlements after reinstalling or switching devices, provided you're signed in with the same App Store or Google Play account used for the original purchase.
6. User-Generated Content
The App lets you add your own custom questions for use in your local game session. Custom questions you write:
Are stored only on your own device and are never transmitted to our servers, shared with other players outside your local session, or published anywhere.
Are entirely your responsibility. You agree not to write custom questions that are illegal, harassing, defamatory, or that infringe someone else's rights.
Are not reviewed or moderated by us, since they never leave your device — this also means we have no ability to access, remove, or recover them for you.
7. Acceptable Use
When using the App, you agree not to:
Use the App for any unlawful purpose or in violation of these Terms
Attempt to interfere with, disrupt, or gain unauthorized access to the App's multiplayer servers or infrastructure
Reverse engineer, decompile, or attempt to extract the source code of the App, except as permitted by applicable law
Use the App to harass, abuse, or harm another player during multiplayer sessions
Circumvent or attempt to circumvent any purchase or entitlement mechanism in the App
We reserve the right to restrict or terminate access to multiplayer features for anyone who violates these Terms.
8. Intellectual Property
The App, including its name, logo, design, original question content, and code, is owned by us and protected by applicable intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the App on your own device for personal, non-commercial purposes, subject to these Terms.
You may not copy, modify, distribute, sell, or lease any part of the App, or reverse engineer it, except as permitted by law.
9. Third-Party Services
The App relies on third-party services to operate, including Supabase (multiplayer infrastructure), Google AdMob (advertising), and RevenueCat (purchase management). Your use of features powered by these services is also subject to their own terms:

We are not responsible for the practices or content of these third-party services.
10. Advertising
Unless you have purchased Remove Ads or Hot Take Pro, the App displays advertisements served by Google AdMob. We do not control the content of individual ads. See our Privacy Policy for details on advertising data.
11. Disclaimer of Warranties
The App is provided "as is" and "as available," without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.
Hot Take is intended for entertainment purposes. The opinion statements in the App are provocative by design and are not intended to reflect factual claims, professional advice, or our own views.
12. Limitation of Liability
To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising out of or related to your use of the App, even if we have been advised of the possibility of such damages. Our total liability for any claim arising from these Terms or the App is limited to the amount you paid us, if any, in the 12 months before the claim arose.
Nothing in these Terms limits any liability that cannot be limited under applicable law.
13. Termination
We may suspend or terminate your access to any part of the App (particularly multiplayer features) at any time if we believe you have violated these Terms. You may stop using the App at any time by uninstalling it.
14. Changes to These Terms
We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top. Continued use of the App after changes take effect constitutes acceptance of the updated Terms.

16. Governing Law
These Terms are governed by the laws of England and Wales. Any disputes relating to these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
